The site “www.yuj.fr” (hereinafter referred to as “the Site”) is the electronic commerce site of the company YUJ YOGA WITH STYLE SAS accessible via the internet network, open to any user of this network. It is published by the company YUJ YOGA WITH STYLE SAS with capital of 105,911 euros whose head office is at 11 Rue Edmond Valentin - 75007 Paris, registered in the Paris trade and companies register under number 79990057600015 and whose VAT number intra-community is FR7630066109130002008400141. The site allows users to purchase services and/or products offered by YUJ YOGA STUDIO.

The site does not allow the purchase of services or products with a view to their resale. Consequently, the user of the site cannot claim any loss of opportunity, exploitation or profit against YUJ YOGA STUDIO.

ARTICLE 1 – SCOPE OF APPLICATION

These General Conditions of Sale and Use are concluded between, on the one hand, YUJ YOGA WITH STYLE SAS, and on the other hand, any natural or legal person purchasing services and/or products on the Site (hereinafter -after designated “Member” for the purchase of a service and “Customer” for the purchase of a product).

They are systematically sent or given to each Member or Customer to enable them to purchase services and/or products offered by YUJ YOGA WITH STYLE SAS. Consequently, placing an order implies the Member's or Customer's full and unreserved acceptance of these Conditions, regardless of any provisions to the contrary that may appear on any document emanating from the Member or Customer, including any general conditions of purchase.

The Member or Customer acknowledges having read these General Conditions of Sale and Use at the time of any order and expressly declares to accept them without reservation. YUJ YOGA STUDIO, however, reserves the right to modify its General Conditions of Sale and Use at any time. In this case, the applicable Conditions will be those in force on the date of the order.

The fact, for YUJ YOGA WITH STYLE SAS, of not taking advantage of one of the provisions of these General Conditions of Sale and Use does not constitute a waiver and does not deprive the company YUJ YOGA STUDIO SAS of the possibility of take advantage of it later.

ARTICLE 2 – SERVICES OFFERED AND PRODUCTS SOLD

2. 1 Services

The services offered are those presented on the Site and in the studios. They include yoga classes for adults and children, workshops/conferences, training.

These services are offered in the form of:

  • à la carte consumption: notebooks valid for 1, 3, 6 and 12 months entitle you to a determined number of courses or sessions in person or online (hereinafter referred to as “course unit”);
  • annual subscription or 3 months unlimited: valid in a Parisian studio of your choice determined during registration, possibility of extension to several studios for an additional package

The services offered give rise to the reservation of an individual or group session or course. The reservation can be made directly on the Site or in the studios.

2.2 Products

The products offered for sale on the Site and in the Studio include, among others, yoga equipment, ready-to-wear clothing, beauty products, candles and perfumes.

ARTICLE 3 – PRICE

The prices of the products and services offered on the Site are prices indicated in euros and all taxes included. Any delivery costs are the responsibility of the Customer.

The prices of products and services are those in effect at the time the order is registered by the Member or Customer.

ARTICLE 4 – ORDERS

4.1 Conditions common to all orders
The order is placed directly on the Site.

The Member or Customer who wishes to purchase a product or service must:

  • complete the identification form on which he will indicate all the requested contact details or give his Member or Customer number if he has one;
  • complete the online order form giving all the references of the products or services chosen;
  • validate your order after checking it;
  • make payment under the stipulated conditions;
  • confirm your order and payment.

Any order constitutes express and irrevocable acceptance of the prices and descriptions of the products and services, as well as these terms and conditions.

YUJ YOGA WITH STYLE SAS confirms its order to the Member or Customer by e-mail within 24 hours (except orders placed on Fridays, Saturdays, Sundays and public holidays).

YUJ YOGA WITH STYLE has, for all stages of access to the Site, the ordering process, delivery or subsequent services, only an obligation of means.

It cannot be held liable for any inconveniences or damages inherent in the use of the Internet network, in particular a break in service or failure of connection to the Site, an external intrusion or the presence of computer viruses, or any fact described as forceful. major in accordance with case law and the law.

The Member expressly and irrevocably acknowledges and accepts the following:

Certification and Medical Certificate: The Member acknowledges having perfect knowledge of the nature of the physical exercises practiced as part of the courses and sessions that he has ordered from the YUJ YOGA STUDIO studio, and certifies on his honor that his physical constitution and his state of health allows him to practice sport in general, and more particularly to practice the activities ordered from YUJ YOGA STUDIO.
The Member releases within YUJ YOGA STUDIO the company YUJ YOGA WITH STYLE SAS, its managers and its members from all claims and legal actions relating to injuries or damage caused to their person and caused in any way whatsoever arising from or in connection with reason for the activity carried out. The Member agrees to assume all risks and consequences linked to the activity carried out within YUJ YOGA STUDIO.
In any case, the Member undertakes to inform YUJ YOGA STUDIO of his medical history and to provide YUJ YOGA STUDIO with a medical certificate less than three months old when the teachers require it. If the medical certificate indicates that the Member is not fit to practice the ordered activity, YUJ YOGA WITH STYLE SAS is entitled to terminate without notice or compensation the contractual relationship with the Member concerned, who will be reimbursed for all or part of the services ordered based on the services already performed.

Cancellation of a reservation by the Member : Any reservation for a private or group session or course may be canceled by the Member up to 12 hours before class time by telephone or directly on the Site for studio classes. The Member cannot cancel their session for online courses even if they will not be able to participate. The studio accepts students arriving up to 5 minutes, after this time the session is lost for the Member and will not in any case give rise to any refund. A penalty of €18 automatically applies for Members who have acquired an annual pass or 3 unlimited months who fail to attend the course for which they are registered. Online courses are neither cancelable nor refundable.

Cancellation of a reservation by YUJ YOGA WITH STYLE SAS: Any reservation for a private or group session or class can be canceled by YUJ YOGA WITH STYLE SAS up to 2 hours before the time of the class or session by telephone or by email addressed to the Member. The corresponding Course Units can be reused until the expiry date of the booklet. Cancellation of a reservation after the deadline cannot in any case give rise to any refund.

Loss and theft: The Member acknowledges being informed that, within the studios, he must deposit his personal effects in the lockable lockers provided for this purpose. The Member is expressly reminded that the changing rooms are not subject to any particular supervision by YUJ YOGA WITH STYLE SAS and that the Member leaves his or her personal effects under his or her sole responsibility. YUJ YOGA WITH STYLE SAS cannot under any circumstances be held responsible for the loss or theft of personal effects left by the Member within the studio premises, and in particular in the changing rooms or lockers.

Insurance: the Member acknowledges having been informed by YUJ YOGA WITH STYLE SAS of the benefit of taking out a personal insurance contract covering bodily injury to which their sporting practice may expose them in accordance with article L 321 -4 of the Sports Code.

Safety instructions: YUJ YOGA WITH STYLE SAS cannot be held liable in the event of an accident resulting from failure to observe the safety instructions set out in particular by teachers, or from inappropriate use of equipment or other facilities.

ARTICLE 5 – PAYMENT

The services and products offered on the Site are payable upon ordering.

5.1 Payment terms

Payment for Member or Customer purchases is made only by bank card: cards from the “CB”, Visa, Eurocard/Mastercard network are accepted.

5.2 Failure to Pay

YUJ YOGA WITH STYLE SAS reserves the right to refuse to honor an order for services and/or products from a Member or a Customer who has not fully paid a previous order or with whom a payment dispute has arisen. in progress.

YUJ YOGA WITH STYLE SAS reserves the right to suspend or cancel any order and/or delivery, regardless of their nature and level of execution in the event of non-payment of any sum due by the Customer, or in case of payment incident.

5.3 Reservation of title

It is agreed that the products delivered and invoiced to the Customer remain the property of YUJ YOGA WITH STYLE SAS until full payment of their price.

ARTICLE 6 – DELIVERY OF PRODUCTS

6.1 Shipping times

The shipping times appearing on the order confirmation email depend in particular on the availability of the products. In the event of a shipping delay, YUJ YOGA WITH STYLE SAS will inform the Customer by telephone or email.

These deadlines are given for information only and cannot be guaranteed, which the Customer expressly accepts.

A shipping delay cannot under any circumstances give rise to the cancellation of the order, the refusal of products, the payment of damages or the payment of any penalty. Likewise, no amount can be deducted from the invoice in this respect.

6.2 Delivery times

Delivery times vary depending on where the ordered product is to be delivered. Delivery times generally observed are 2 to 5 days for deliveries in mainland France.

In accordance with the provisions of article L. 121-20-3 of the Consumer Code, delivery of the products ordered will take place no later than 30 days from the day following the order subject to full payment of the price.

6.3 Place of delivery

The products ordered will be delivered to the address given by the Customer when ordering.

ARTICLE 7 – RIGHT OF WITHDRAWAL AND RETURN

The Member or Customer has a period of fourteen (14) clear days to request an exchange or refund of the products or services ordered without penalty, with the exception of return costs. This period runs from confirmation of the order if the Member has ordered a service and from receipt of the product by the Customer if the latter has ordered a product.

Regarding the order of a product, the Customer must return his order by registered mail to YUJ YOGA STUDIO 11 RUE EDMOND VALENTIN 75007 PARIS, indicating unequivocally his intention to withdraw and specify whether he wishes a refund or an exchange. He must attach his order number or purchase invoice. The refund or exchange assumes that the product has not been damaged by the Customer or that it has not been returned incomplete. The product must also be returned in packaging guaranteeing its proper transport and safety.

In the case of a service, the Member must send a RAR letter unequivocally indicating their intention to withdraw and specify whether they wish a refund or an exchange. He must attach the order number or purchase invoice.

In accordance with the provisions of the Consumer Code, the right of withdrawal cannot be exercised for a service whose execution has begun.

Any order returned to an address other than this one will be refused without suspension of the withdrawal period.

The costs of returning any product will be the sole responsibility of the Member or Customer.

Reimbursement of products after return will be made as soon as possible and at the latest within fourteen (14) clear days following receipt of the letter or package.

Any deadline expiring on a Saturday, Sunday or public holiday will be extended until the next business day.

This right of withdrawal only concerns products and services purchased on the Site.

ARTICLE 8 – COMPLIANCE AND GUARANTEE

The Customer must ensure that the products delivered to him correspond to his order. In the event that the products delivered do not conform to their order, the Customer must inform YUJ YOGA WITH STYLE SAS by email or by telephone and return the products in question under the conditions set out in article 7 of these General Conditions of Sales and Use.

The products sold by YUJ YOGA WITH STYLE SAS are subject to the legal guarantees of articles L. 211-4, L. 211-5 and L. 211-12 of the Consumer Code and articles 1641 and 1648, first paragraph of the Civil Code . Any warranty is excluded in the event of misuse, negligence or lack of maintenance on the part of the buyer, as well as in the event of normal wear and tear of the goods, accident or force majeure.

The Member or Customer is informed that in accordance with law n°78-17 of January 6, 1978, relating to data processing, files and freedoms, the information that he communicates through the forms present on the Site are necessary to respond to their requests and are intended for YUJ YOGA WITH STYLE SAS, as data controller for administrative and commercial management purposes.

YUJ YOGA WITH STYLE SAS undertakes to ensure that no personal information of the Member or the Client is published without their knowledge, exchanged, transferred, assigned or sold on any medium to third parties.

9.2 Cookies

The Site uses cookies. The cookie is a computer file stored on the hard drive of the customer's computer. Cookies are only used by YUJ YOGA WITH STYLE SAS for the purpose of personalizing the service offered. ARTICLE 10 – INTELLECTUAL PROPERTY RIGHTS

Any dispute likely to result from the validity, interpretation, execution, termination, their consequences and their consequences of these General Conditions of Sale and Use will be subject to the exclusive jurisdiction of the French courts.

ARTICLE 13 – INDEPENDENCE OF CLAUSES
